Terms of Service

1. Acceptance of Terms

By accessing or using ServSmart, you agree to be bound by these Terms and our Privacy Policy. If you are using ServSmart on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

ServSmart provides software for scheduling, customer management, quoting, invoicing, payments, messaging, and related operations for home- and field-service businesses. Features available to you depend on your subscription plan.

3. Accounts and Eligibility

You must be at least 18 and provide accurate registration information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Payments and Billing

Paid plans are billed in advance on a recurring basis. Online customer payments are processed by Stripe; bank connections are provided by Plaid. You authorize us to charge your payment method for applicable fees. Fees are non-refundable except where required by law. Refunds are governed by our published Refund Policy at /legal/refunds.

Usage-based charges (such as SMS, AI, or storage overages) are billed as incurred per your plan.

5. SMS Terms (Text Messaging Program)

By providing your mobile phone number and enrolling in the ServSmart SMS program, you agree to receive recurring transactional text messages from ServSmart (operated by White Harvest LLC), including payment confirmations, invoice reminders, security alerts, appointment reminders, and account notifications. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. For additional assistance, contact contact@servsmart.app or call 1-844-651-4202. Wireless carriers are not liable for delayed or undelivered messages. Participation in this program is subject to our Privacy Policy and Terms of Service.

Program: ServSmart account notifications, operated by White Harvest LLC dba ServSmart. Enrollment is optional and is not a condition of purchase or of using ServSmart.

Message types: payment confirmations, invoice reminders, security alerts, appointment reminders, and account notifications. Message frequency varies. Message and data rates may apply.

6. Your Customers' Data

You may store information about your own customers in ServSmart. You are the controller of that data; ServSmart processes it on your behalf to provide the service. You are responsible for having a lawful basis to collect and use it, including consent for any SMS or email communications you send through the platform to your own customers.

7. Acceptable Use

You agree not to: use the service for unlawful, deceptive, or harassing purposes; send unsolicited marketing without consent; attempt to breach security or access other tenants' data; reverse-engineer the platform; or resell the service without authorization.

8. Third-Party Services

ServSmart integrates with third parties including Stripe, Twilio, Resend, Anthropic, Plaid, Google Maps, and Supabase. Your use of those features may be subject to the third party's terms. We are not responsible for third-party services.

9. Artificial Intelligence Features

Some features use AI to draft messages, categorize transactions, estimate durations, and provide suggestions. AI output may be inaccurate; you are responsible for reviewing it before acting. AI processing is scoped to your tenant and is not used to train shared models across tenants.

10. Intellectual Property

ServSmart and its software, design, and trademarks are owned by White Harvest LLC dba ServSmart. You retain ownership of the data you submit. You grant us a limited license to host and process your data solely to provide the service.

11. Data Portability, Number Portability, and Termination

Data portability. Your business data is yours. At any time, on any plan, and at no charge, you may export your customers, jobs, invoices, conversations, photos, and a complete account archive from Settings → Export your data.

Number portability. Any phone number we provision for you is yours to take with you. You may request its release — to your own Twilio account, to another carrier, or for discontinuation — from Settings → Move my number, and we will release it from our account to enable the transfer.

Termination. You may cancel at any time from your account settings. After cancellation your account remains accessible in read-only mode for 30 days so you can finish any exports and move your number, after which your data is deleted as described in our Privacy Policy.

12. Disclaimers

The service is provided “as is” without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free. ServSmart is not an accountant, lawyer, or tax advisor; reports and bookkeeping features are tools, not professional advice.

13. Limitation of Liability

To the maximum extent permitted by law, ServSmart's total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages.

14. Indemnification

You agree to indemnify and hold ServSmart harmless from claims arising out of your use of the service, your data, or your communications with your customers, including any messaging-consent or privacy violations.

15. Changes to the Service or Terms

We may modify the service or these Terms. Material changes will be posted here with an updated date. Continued use after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Wyoming.
